Terms of Service

1. Acceptance of terms

By signing up for or using fotoz.in (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. If you are accepting these Terms on behalf of a studio or company, you represent that you are authorised to bind that entity.

2. Description of service

fotoz.in is a software-as-a-service platform that helps professional photographers manage event photo selection and delivery. The Service includes:

• A web dashboard for photographers (app.fotoz.in)
• A desktop helper application for uploading event previews
• A web gallery for clients to view and select photos (gallery.fotoz.in)
• Backend APIs, storage, watermarking, and PDF report generation

The Service is provided on an "as-is" basis. We are continuously improving the product and may add, change, or remove features at any time with reasonable notice.

3. Your account

You must be at least 18 years old and legally capable of entering into a contract to create a photographer account. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorised access (security@fotoz.in)
• Providing accurate registration information and keeping it up to date

4. Acceptable use

You agree not to use the Service to:

• Upload content you do not have the right to use, distribute, or modify
• Upload sexually explicit material involving minors, content that promotes violence, or content that violates Indian law
• Reverse-engineer, decompile, or attempt to extract the source code of any component
• Access the Service through automated means except via APIs we have explicitly published
• Resell, sublicense, or expose the Service as your own product without a written reseller agreement

5. Your photos & intellectual property

You own everything you upload. By using the Service, you grant fotoz.in a limited, non-exclusive, royalty-free licence to store, process, transmit, watermark and display your photos solely to provide the Service to you and your authorised clients. We do not claim ownership of your photos and will never use them for marketing without your separate, explicit written consent.

Original RAW files never leave your computer — only compressed previews are uploaded.

6. Your clients' data

When a client accesses a gallery you create, they submit their name and phone number. You are the Data Fiduciary (as defined in the DPDP Act, 2023) for your client's data; fotoz.in is the Data Processor. You agree to:

• Have a lawful basis (typically the client's contractual relationship with you) to invite them to a gallery
• Honour any data-access or deletion request a client makes to you
• Use the gallery and selection data only for the photography service you are providing

fotoz.in will delete client gallery data within 90 days of gallery expiry, or sooner on request.

7. Subscription & billing

Paid plans are billed monthly or annually in advance through Razorpay. By subscribing, you authorise us to charge the payment method you have provided on a recurring basis until you cancel.

• All prices are in Indian Rupees (₹) and exclude applicable GST unless stated otherwise.
• A 14-day free trial is available on the Standard plan. No payment method is required to start the trial.
• If a recurring charge fails, your account moves to a 7-day grace period. After that, the account is suspended; data is retained for 60 days, then deleted.
• Refunds are governed by our separate Refund & Cancellation Policy.

8. Cancellation & termination

You may cancel your subscription at any time from Settings → Billing. Cancellation takes effect at the end of the current billing period; you retain access until then.

We may suspend or terminate your account if you breach these Terms, fail to pay, or use the Service in a way that creates legal exposure for us or our users. Where reasonable, we will give you 7 days' written notice and an opportunity to remedy the breach.

9. Limitation of liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of merchantability or fitness for a particular purpose.
• Our total aggregate liability for any claim arising out of or related to the Service is limited to the amount you paid us in the 12 months preceding the claim.
• We are not liable for indirect, incidental, special, or consequential damages, including lost profits, lost goodwill, or lost data.

10. Indemnity

You agree to indemnify and hold fotoz.in harmless from any claim, demand, loss or expense (including reasonable legal fees) arising out of: (a) your breach of these Terms, (b) your photos or content, or (c) your interaction with your clients via the Service.

11. Governing law & jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka.

12. Changes to these terms

We may update these Terms from time to time. Material changes will be notified by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
